By contracting The Art Hour LLC for your appraisal, consulting or brokerage needs, you agree to abide to the following Terms and Conditions:

By using any of our services you state that you are over 18 years of age and capable of entering into a contract and being legally bound by it.

All information provided to us, including your name, address, telephone number, email address, particulars about your item(s), will be kept confidential.

Information provided to us regarding your item is deemed accurate and complete. The Art Hour LLC shall not be held liable nor shall it be accountable in any manner for any errors or omissions due to inaccuracy or missing information provided to us. The Art Hour LLC calls for the production of any documents as are available in your possession or control (i.e. invoices, sale receipts, Certificates of Authenticity, previous insurance schedules, previous appraisal reports, etc.)

All issues regarding fees and services must be clarified prior to commencement of work. You are responsible for paying all fees associated with services agreed upon. The Art Hour LLC accepts a 50% deposit for appraisal requests, with the remaining balance due and payable upon completion of the report.

Fees and/or commissions include, but are not limited to, research time, report preparation time, additional expert consultation, photography and advertising related expenses, listing fees (when appropriate), and other expenses as the case may be.

The Art Hour LLC makes no representation and offers no warranty as to the future use of the report, except as specifically agreed upon and provided for in the report. Said appraisal report shall not be disseminated to, nor relied upon nor used by, any third party unrelated to the immediate purpose of this appraisal.

You shall indemnify, defend and hold us harmless from and against any actions, claims, liabilities or expenses incurred as result of claims based on or arising from the appraisal, by third parties unrelated to the immediate purpose of this appraisal.

Appraisals provided by The Art Hour LLC are not statements or representations of fact, nor representations of warranty with respect to authenticity, genuineness or provenance.

All appraisal reports provided by The Art Hour LLC contain firm statements of value. Estimated values are current as of the effective date of the appraisal report. The Art Hour LLC offers no warranty as to the future increase or decrease of appraised values. The Art Hour LLC maximum liability is capped at total fee for services provided, not the estimated value of items appraised.

The Art Hour LLC reserves the right to decline any request for appraisal or appraisal related services.

When providing consulting services, The Art Hour LLC develops an analysis based on current market conditions and offers recommendations according to your needs.

By placing an item for sale with The Art Hour LLC, you declare, represent and warrant that you are the legal owner of that item and/or that you have the legal authority to offer the item for sale. By hiring The Art Hour LLC as your Broker in the sale of an item, you retain The Art Hour LLC as your sole and exclusive agent in connection with that sale.

The Art Hour LLC is not responsible for items sent to us without prior consent to do so. The Art Hour LLC is not responsible for shipping costs in connection with the return of items sent to us.

The Art Hour LLC does not endorse and is not responsible for the accuracy of information, content or availability of any product or service provided by third parties.

The Art Hour LLC reserves the right to change the Terms and Conditions set forth herein. Once posted, such changes shall be effective immediately. All disputes arising from non-compliance to these Terms and Conditions are subject to the jurisdiction of the Michigan Courts.
